We recently bought an Australian Shepard from a breeder under the impression that she would be a standard. Upon a DNA test, the results came back that our dog is a mini Australian shepherd. Do we have any potential courses of action? We will absolutely not give the dog back or away.

Answer

Being under the “impression” that a dog is a particular breed is not the same as having a contract which specifies the breed of dog. If there is a breach of contract, a lawsuit may be commenced to try to get compensated for the difference in monetary value between the dog purchased and the dog represented. In some instances, there is no difference in monetary value. I hope that you and your “mini” dog have a happy life together.
