Animal Control took three dogs, but only gave two back.

The Animal Control took away my three dogs, then only gave back two. Can I do something about getting the third dog back?

Answer

Rights would depend on the facts and circumstances surrounding the seizure. For example, when dogs are seized for running at large the dogs’ “parents” are typically allowed to retrieve their dogs upon payment of an impound fee and compliance with other state and local requirements that may be in effect, such as spay/neuter, license, and vaccinations. If dogs are seized for other reasons, the process of getting them returned is often more complicated. When there is concern that a dog is dangerous or is being mistreated, the dog may be held pending legal proceedings, such as a dangerous dog hearing or criminal prosecution. People who believe that their animal is being wrongfully withheld can contact the police and can commence a civil lawsuit to try to get the animal returned and/or for monetary compensation. Time is of the essence. After an animal is rehomed, it becomes much more difficult to get the animal returned. I hope all the dogs are doing well.
