Esa dog confiscated by animal shelter because of breed ban.

Question

If you have an esa dog and the animal shelter confiscated them, is it legal for them to hold them if there was no cause for them being confiscated other then the breed being banned from the city but, with the exception that it is an esa animal.

Answer

Breed specific ban laws do not generally apply to the keeping of service or emotional support animals. Under most circumstances, it would not be lawful to confiscate, withhold, or order the removal of a service or emotional support dog solely because the dog is of a breed that is banned in the locality.
