If there is a false report of animal abuse on my dog can I get a defamation lawsuit on them?

Answer

People can sue for defamation and seek monetary damages for losses suffered. The likelihood of success will depend on the facts of each case. If the case is based on the filing of a false police report, it will be necessary not only to prove that the report was false but also that the person making the report did so knowing it was false. It will also be necessary to prove damages suffered, such as harm to one’s reputation or loss of a job. If no damages can be demonstrated, one should not expect to be awarded money.

The police and other law enforcement officers rely on the public to report animal abuse. Sometimes officers cannot verify the mistreatment and the person who allegedly mistreated the animal is not charged. That does not necessarily mean the abuse did not take place. I hope the animals are doing well!
