How can I get my dog back ASAP?

Question

The police did a welfare check on me and then I went to the hospital for about 2 hours. When I got home my dog was gone. I originally thought my friend came by for me to watch her until I was out. I called to tell my friend I was home and she could drop my dog off, but turns out she didn't have her. I immediately called Animal Control to find out of they have her. They did and that's when I was informed they were called there by the police to get my dog. I had no knowledge of this. I had her put up so cops could do their thing but not once did they say animal control was coming to take her. How can I get her back? She is my therapy dog and I really needed her the other day. Please help. How can I get my baby back?

Answer

Usually if animal control takes an animal because the owner is unavailable due to illness, the animal will be returned if efforts to retrieve the animal are made in a timely manner (unless there are concerns regarding the animal’s care). People who believe their animal is being wrongfully withheld can sue (replevin action) to try to get the animal returned. After an animal is rehomed, these cases can become much more difficult to win. I suggest you consult with an attorney in your state for possible next steps.
