Is it legal for Animal Control to take dog when no one is home?

The neighbors put a noise complaint on my girlfriends dog and Animal Control took it while she was at work. Is this legal?

Answer

Laws generally provide for fines for violations of noise ordinances, not seizure of dogs. Law enforcement officers often need a warrant to seize animals on private property. There are exceptions, such as in exigent circumstances where an animal’s life may be in immediate jeopardy. Retrieving a seized animal in a timely manner is important since after the redemption period is over, people may lose rights to their animals. I hope these dogs are getting humane care.
