What are the laws on what Animal Control can and cannot do?

Is it illegal for Animal Control to come onto my property and take my dog that was on a chain in backyard without my knowledge or consent when there are no trespassing signs up?

Answer

Some states and many municipalities have laws to ban or restrict chaining/tethering dogs. For example, in Lawton, Oklahoma, the ordinance states, in part: “No person shall, at any time, fasten, chain, or tie any dog or cause such dog to be fastened, chained or tied while such dog is on the dog owner’s property or on the property of the dog owner’s landlord.” Every state also has an animal cruelty law. Law enforcement officers may charge an animal’s caretaker with violating this law too when an animal is chained under certain conditions.

Dogs who are chained/tethered can become entangled, are exposed to the elements, and are “sitting ducks” for other animals (and people). Dogs require exercise, socialization, and the ability to move without continuous restraint. When chained, dogs can become anxious and aggressive. I hope this all works out well for the dog!
