Question
I have a warrant against my ex-boyfriend in a domestic case. He took the dog that is registered to me. I’m legally trying to get her back. Police are saying it’s a civil matter. I have her registration in my name, her adoption papers, and proof of payment for paying for the dog.
Connecticut, USA
Answer
Protection orders in Connecticut can include “provisions necessary to protect any animal owned or kept by the applicant including, but not limited to, an order enjoining the respondent from injuring or threatening to injure such animal.” Consider retaining an attorney to see if your protection order can be expanded to include returning the animal to you.
Many states already have order of protection laws that specifically state that the court may grant to the petitioner the exclusive care, possession, or control of any animal owned, possessed, leased, kept, or held by either the petitioner or the respondent or a minor child residing in the residence or household of either the petitioner or the respondent and may order the respondent to stay away from the animal and from taking or otherwise disposing of the animal. While Connecticut’s law is not that specific, it seems to provide judges with leeway to order more than enjoining the respondent from harming or threatening to harm the animal.
A civil lawsuit, such as replevin action, can also be commenced to try to get an animal returned.
